As a CAMFT staff attorney, Bradley J. Muldrow, Esq. takes member phone calls regarding law and ethics issues and contributes articles on those subjects to CAMFT's publication, the Therapist. Prior to joining CAMFT's legal team, Brad worked on litigation and regulatory matters as an attorney for San Diego Gas & Electric Company.

Since becoming an attorney, Brad has given law and ethics presentations to attorneys and judges as a J. Clifford Wallace Inn of Court member. He has also served as a board member for the Earl B. Gilliam Bar Foundation, a San Diego-based nonprofit.

Workshop Description:

In our increasingly fast-paced world, therapists and patients alike often find themselves struggling to navigate busy schedules and limited availability. Emailing and texting offers these parties a flexible, convenient way to keep in touch- especially when things get hectic. Understanding the regulations governing these forms of communication can help therapists protect their licenses and their patients’ health information.  

Join CAMFT staff attorney Bradley Muldrow, JD for an engaging discussion regarding legal and ethical issues therapists must navigate when emailing and texting their patients. In addition to providing an overview of the legal guidelines and ethical considerations for emailing and texting patients, the workshop will address practical considerations, such as: 1) determining whether emailing and texting are appropriate forms of communication in certain instances; 2) common confidentiality breaches to avoid when emailing and texting; and 3) setting appropriate boundaries with patients when using these forms of communication.


Learning Objectives:

  1. Participants will be able to identify the two-step process the Department of Health and Human Services Office for Civil Rights expects HIPAA-covered entities to follow prior to communicating with patients via unencrypted email.
  2. Participants will be able to identify two important differences between encrypted and unencrypted messages.
  3. Participants will be able to identify two common confidentiality breaches and how to avoid them.
